Supreme Court in Calcutta State Transport Corporation vs. Ashit Chakraborty [Civil Appeal No. 3462 of 2023] on May 8, 2023, observed that for any fault of the employer, employees should not made to suffer. The Court made the said observation while examining the case of pensioner who had exercised his right to receive pension under the regulations as applicable on him, however, the employer ignoring the said election by the employee, continued to make salary deductions towards provident fund.
