Bombay High Court in Ramchandra Lakhantal Awate vs. The Chief Officer, Municipal Council and Ors. W.P No. 4722/2008, observed that it is the employee who is required to discharge the burden of proving the existence of employer-employee relationship with the employer against whom the employee is claiming remedy on the ground of unlawful termination.
