VRS benefit on a lower pay scale cannot be retrospectively varied: Delhi High Court

Delhi HC in Bses Rajdhani Power Ltd. vs. D.P. Sharma CM APPL. 16153/2023, dismissed the petition of an employee claiming voluntary resignation benefits on a higher pay scale, which was based on a single bench’s judgment that had set aside the order imposing punishment on the employee. The Court noted that since the employee had opted for the Special Voluntary Retirement Scheme (SVRS) package, they could not later claim additional financial benefits based on the impugned judgment. The Court emphasized that the SVRS and the benefits availed under it constituted a package deal, and its elements could not be retrospectively altered.
