Allahabad High Court in Kul Bhushan Mishra vs. State of UP (Writ- A No.- 10209 of 2023) while examining the validity of the employer’s transfer policy wherein employer has imposed certain restrictions and conditions for the employees requesting for transfer held that the employee cannot claim transfer as a matter of right and it is always at the discretion of the employer to decide whether the employee is to be transferred or not and may impose conditions and restrictions on the said transfer.
