Patna High Court in Om Prakash Singh vs. the State of Bihar and Ors. while accepting the contention of employer that the claim of employees is completely barred under Section 20(2) of the Minimum Wages Act, 1948, as the same is to be presented within 6 (six) months from the date on which the minimum wages (or other amount) became payable, overturned the award passed by the Assistant Labour Commissioner on the ground that the employees have not filed the application for condonation of delay showcasing a sufficient cause for not making the application within time as required under the Section 20(2) of the Minimum Wages Act, 1948.
