The burden of proof in disciplinary proceeding depends upon the nature of charge against the employee: SC

Supreme Court in State Bank of India vs. A.G.D. Reddy [Civil Appeal No. 11196 of 2011] held that the burden of proof in disciplinary proceedings depends on the specific nature of the charge leveled against the employee and the explanation provided by the employee. Further, the Court re-iterated the settled principle of law that there is a limited scope of judicial review in departmental enquiry proceedings.
