Temporary workers cannot be exploited by replacing regular workers: Calcutta HC

Calcutta High Court in Kaushik Ghosh & Ors. vs. The State of West Bengal &Ors. (MAT 163 of 2021), on June 21, 2023, although upheld the view taken by the lower court wherein it was held that appointment of temporary workers cannot be regularized unless they are appointed in accordance with prescribed recruitment rules, however the High Court held that it also must be kept in mind that the temporary employees on the basis of contractual services should not be engaged in perennial jobs and the employer should not be allowed to exploit the services of temporary workers in place of regular employees for years together at a meagre pay.
