After eight years of POSH Law, do you think it has achieved its objectives and has delivered what was expected of it?
AK Yes, to certain extent but with riddles which requires effective implementations and executions through effective administrative check and balances which are still lacking. To answer this question, I would like to cite quote from Bill Cosby “Is the glass half full or half empty? It depends on whether you are pouring, or drinking”. Likewise, in regards to the subject POSH, the guidelines persisted from the past since 1997 i.e since Vishaka Judgment era. But during that time also, the major observations made by the Supreme Court was the adaptability of the said law amongst the organisation. It was only in 2013, after the Nirbhaya case got a hype at Delhi, that this enactment got a push and finally the Sexual Harassment of women at Workplace (Prevention, Prohibition & Redressal) Act 2013 was enacted and made applicable for all the organisations irrespective of belonging to any sector i.e Public, Private,...
