SC issued notice to Govt. for ensuring independence of IC members under PoSH Act

Supreme Court issued a notice to the Ministry of Women and Child Development in the Public Interest Litigation (PIL) Janaki Chaudhry and Anr. vs. Ministry of Women and Child Development Through the Secretary and Ors. (W.P.(C) No. 000796/2024). on December 7, 2024 . The PIL has raised concerns about the deficiencies in the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013, specifically regarding the protection of service conditions of members of the Internal Committee (“IC“). The petition seeks to secure the independence of IC members, as they face job loss in the private sector when their decisions on sexual harassment cases do not align with senior management’s preferences. This dynamic, according to the petition, poses a barrier to effectively addressing the issue of sexual harassment in the workplace. The Court has called for the Ministry of Women and Child Development to review and provide recommendations for better protection of IC members.
