Supreme Court passed an interim order in relation to a writ petition Seema Girija Lal &Anr. vs. Union Of India &Ors. 29329/2021, wherein the petitioner highlighted that the diverse provisions of the Rights of Persons with Disabilities Act 2016 (“Disabilities Act”) have not been implemented by the states. In the said petition the petitioner highlighted that only 10 (ten) states had constituted separate departments for dealing with the entitlements of persons with disabilities; only 12 (twelve) states have independent Commissioners; the states of Andhra Pradesh and Maharashtra and the Union Territories of Dadra and Nagar Haveli, Daman & Diu and Ladakh are yet to notify the rules under the Disabilities Act and have not constituted State Advisory Boards.

Further, in the petition it was also stated that the constitution of District Level Committees for each district for the purpose of ensuring that the needs of persons with disabilities are met is yet to be fully implemented. In this regard the Supreme Court directed the Central Government to file a counter affidavit within a period of 1 (one) month dealing with specific issues in regard to the lack of effective implementation of the Disabilities Act. The Supreme Court also directed that the said affidavit shall indicate the state-wise status of compliance in regard to the matters which are raised in the petition.
