Jharkhand High Court in Shanti Devi vs. the State of Jharkhand W.P(S) No. 3987/2021, addressed the issue of a retired employee whose pension, gratuity, group insurance, and leave encashment benefits were withheld by the employer due to pending criminal cases. The Court observed that withholding retiral benefits solely based on the pendency of criminal cases, without initiating disciplinary proceedings against the employee, is not justified.
