Chhattisgarh High Court, in Chhattisgarh State Civil Supplies Corporation & Ors. v. Shailendra Kumar Khamparia & Ors., W.A. No. 655 of 2024 , dealt with the legal validity of a resignation acceptance. The employer had attached preconditions, requiring the employee to submit a fresh resignation application and deposit three months’ salary before proceeding. The Court observed that these preconditions were neither met nor addressed by the employee, rendering the original resignation application stale. It further noted that the employer’s repeated demands for a salary deposit undermined the procedural validity of the resignation acceptance. Under these circumstances, the Court held that the resignation could not be acted upon, as it had effectively become non-existent.
