No denial of Back wages upon Reinstatement when Rules 'Do Not Provide for 'No Pay' Punishment During Suspension

Telangana High Court in A. Rajaram Reddy vs. Additional Collector/PIC Chairman Karimnagar Cooperative Urban Bank & Ors. (Writ Petition No. 4307 of 2024),  recently held that employers cannot impose punishments not prescribed under statutory rules. The court observed that if an employee is acquitted of criminal charges, the employer must consider imposing a lesser punishment. Given that most charges against the employee were proven, the court directed a partial payment of back wages.
