No benefit to PF member after 36 months of retirement on his PF accumulations: Delhi HC

Delhi High Court in Chief Provident Fund Commissioner & Ors. vs. Alok Kumar Agarwal & Anr. (LPA 486/2021 & 124/2022) On July 14, 2023, reiterated the settled principle that in terms of paragraph 72(6) and 60(6) of the Employees’ Provident Fund Scheme, 1952 (“EPF Scheme“), it is clear that in case a member of EPF retires from employment and has not chosen to withdraw the amount in his account, no interest shall be payable on such amount after a period of 36 (thirty-six) months from the date it becomes payable.
