The law must take care to protect women of differing perceptions and comfort levels. At the same time, the reaction of the complainant cannot be entirely unreasonable. A "calibrated balance" would have to be struck between rights of a victim of sexual harassment and those of the delinquent employee.

After 10 years how do you find this law in meeting its objectives?

AB Well, certainly, the POSH Act has created lot of awareness amongst the stake-holders about the problem of “sexual harassment” at work. Most of the professionally managed companies/organisations have created the necessary complaint mechanisms and formulated policies for combating the menace of sexual harassment at the workplace. Employees, particularly female employees, have become much more aware and conscious of their fundamental right to gender equality and the concomitant obligation of the employers to ensure that their workplaces remain free from “sexual harassment.” Working women do not want the “succour” of any special provisions. They simply want their constitutional guarantees to be enforced. This is a very “heartening” trend.
