Calcutta High Court, in Indian Oil Corporation Limited vs. Union of India &Anr. (WPA 27693 of 2024), recently held that lengthy and uninterrupted service in essential functions warrants regularization, even when the workload has been reduced. The court emphasized that misusing temporary employment labels to deny employees their rightful claims contradicts principles of fairness and equity. Additionally, it highlighted that failing to regularize temporary ’employees, despite their integral role in the organization, not only contravenes international labor standards but also exposes the employer to legal challenges and negatively impacts employee morale. Consequently, the court laid down guidelines for the regularization of casual workers.
