Judicial review is meant only to ensure fairness in treatment : Madras High Court

Madras High Court in the Management, Anthiyur Consumer Co-operative Store Limited vs. R. Parthiban WA No. 1402/2024,on October 17, 2024,  upheld the labour court’s order setting aside the termination of an employee following an inquiry into alleged misconduct. The Court further emphasized that the power of judicial review by a Constitutional Court is not an appellate remedy, where the court substitutes its own findings. Instead, judicial review is limited to ensuring fairness in the process, not the fairness of the conclusions reached by the disciplinary or appellate authorities, unless those findings are perverse or unsupported by evidence.
