Insurance Company liable to pay compensation only under ECA when vehicle driven by deceased in course of employment: Rajasthan HC

Rajasthan High Court in New India Assurance Co. Ltd. vs. Gain Singh & Ors. [S.B. Civil Miscellaneous Appeal No. 1219 of 2001] referring to provisions of section 147 of the Motor Vehicles Act, 1988 held that the said provision clearly indicates that when the driver of the insured vehicle is plying the motor vehicle of the insured (employer in the instant case), and if such vehicle meets with an accident, thus, the liability of the insurance company would be restricted to payment of compensation under the provisions of the ECA.
