Madhya Pradesh High Court in I.D. Makrani vs. State of Madhya Pradesh &Ors.[WP No. 8370/2023], while quashing the suspension order of an employee held that merely forwarding a message in a WhatsApp group should not be automatically construed as an expression of the employee’s personal opinion. The court further referred to the Madras High Court judgment in A. Lakshminarayanan vs. Assistant General Manager [W.P (MD) No.9754/2023], wherein the court observed that an employee has the right to vent and the management cannot take disciplinary action for messages sent in a private WhatsApp Group as long as they are within the legal bounds.
