Form 16 is a reliable to determine the real income of the deceased employee: Bombay High Court

Bombay High Court in Anjali Vilas Deshpande &Ors vs. Prabha Rajemndra Gupta &Anr.on November 18, 2022, while determining the compensation payable to the representatives of deceased employee under the Motor Vehicles Act, 1988 examined whether income of the deceased can be determined as per the figures reflected in Form 16 (signed and generated by the employer of the deceased) and observed that Form 16 is a reliable piece of evidence to determine the real income of the deceased employee and the entries in Form 16, should be considered which reflects the total income of the employee.
