Recently, the Uttarakhand High Court in Hashmi vs. Jalaluddin and Ors. Appeal from Order No. 210/2011, while allowing the compensation along with the interest to the dependants of deceased workmen reiterated the judgment of Supreme Court given in Ved Prakash Garg vs. Premi Devi and others 1997 (2) UJ 686, wherein it was observed that compensation and interest would remain part and parcel of the legal liability of insured to be discharged under the Employees’ Compensation Act, 1923 (“ECA“).
