Bombay High Court in Abhimanyu Laxman Kumbhar vs. The Maharahtra State Electricity Distribution Company Limited W.P.C No. 14327/2021,on September 27, 2022, while answering the question as to whether an employer is justified in denying wages to the employee during pendency of appeal against his acquittal on the principal of no work no pay, observed that mere pendency of appeal against acquittal would not continue to attract disqualifications of pendency of criminal trial and this analogy can easily be applied to right of an employee to seek reinstatement during pendency of appeal against acquittal.
