Guwahati High Court in Hemanta Changmai vs. State of Assam & Ors., W.P. (C) No. 4849 of 2022, set aside the employer’s decision to revoke an employee’s promotion due to serious irregularities in the process. The court held that revoking the promotion without providing the employee an opportunity to be heard violated the principles of natural justice and administrative fairness, making such an action unsustainable in law.
