Employee has right to get voluntary retirement

Allahabad High Court, in AS vs. State of U.P. (WP No. 9427/2023), affirmed the employee’s fundamental right to life and personal liberty under Article 21 of the Constitution of India by directing the employer to accept the employee’s voluntary retirement request. The Court observed that compelling the employee to continue working could result in irreparable harm, given her severe depression and anxiety neurosis, on account of which she is unable to perform prolonged sitting or desk work as per the doctor’s recommendation.
