Punjab & Haryana High Court, in Narinder Kaur vs. State of Punjab and Others (CWP-2543-2025 (O & M)), held that an employee who acquires a disability during service is entitled to continued salary, benefits, and a supernumerary post, along with interest on withheld dues. Referring to Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, the court reiterated that employees who become disabled while in service must be accommodated in another post with the same pay scale and benefits. If no suitable post is available, the employer must create a supernumerary post to ensure continued employment and financial security until the employee reaches superannuation. Consequently, the court directed the employer to pay all outstanding salaries and benefits, including interest on withheld amounts.
