Himachal Pradesh High Court in National Insurance Company Ltd. vs. Govind Ram and Ors. FAO No. 453/2014, while examining the question as to whether the claimant is entitled to reimbursement of the medical expenditure under the Employees Compensation Act, 1923 (“ECA“) from the date of accident, observed that it is settled law that person becomes entitle to compensation under the ECA on the date on which cause of action arises and the ECA does not have a retrospective effect; since there being no provision under the ECA to grant medical reimbursement at the relevant time, therefore claimant is not entitled to the said reimbursement.
