ECA Compensation to be awarded when accident caused during course of employment: Andhra Pradesh HC

Andhra Pradesh High Court in The New India Assurance Company Ltd. vs. Smt. M. Lakshmi Ramateer tham and others. C.M.A No. 430/2010, on September 13, 2022 observed that the Commissioner designated under Employees’ Compensation Act, 1923 (“ECA“) is legally required to assess whether the accident was out of and in the course of employment or not and upon such a specific finding, the claim should have been decided.
