Documentary evidence of Date of birth will prevail over employee admission: Orissa HC

Orissa High Court in Management Committee, CFH Scheme, Paradip Port vs. Paradip Port Workers Union and another W.P(C) No. 14256/2021, on February 21, 2023 while examining the issue as to whether documentary evidence produced by the employee reflecting his date of birth is better evidence than the employee’s signed acknowledgment of alterations made with respect to his date of birth, observed that there was no allegation by the employer in its written statement to the effect that the documentary evidence produced by the employee was either forged, fabricated or manufactured, therefore corrections, accompanied by signature and date put by the employee may at best amount to an admission on his part that he was born on a particular date, however admission cannot stand in face of the documentary evidence, borne out by the school leaving certificate.
