Court can lift the veil to see motive behind the termination

Jammu and Kashmir High Court in Rokade Santosh Sandashiv&Anr. vs. Union of India and Anr. SWP. No. 1219/2011,on March 10, 2023, quashed the termination order passed by the employer declaring that it was not a termination simpliciter, as it was based on the ground that the employees supplied forged experience certificate of in relation to their matter of employment, which implies that they were terminated on account of misconduct. The Court further held that the employees were required to be given an opportunity of being heard and the inquiry was to be undertaken, but in the instant cases, neither of those things have happened.
