Conduct of the employer also to be considered while granting back wages

Madhya Pradesh High Court in Executive Director, Environmental Planning and Coordination Organisation (MP) vs. Presiding Officer, Labour Court, Rewa (MP) Writ Petition No.3056 of 2001, on February 3, 2023,  observed that while granting back-wages, the length of service of an employee is required to be taken note of, however at the same time, the conduct of the employer is also required to be seen. The Court made the said observations while noting of the facts of the case where employer though contested the matter pertaining to grant of back-wages but did not show any seriousness to dislodge the stand taken by workman or to dislodge the finding given by the Labour Court.
