Contract labour can at least succeed in getting the pay scale or rates applicable to regular employees or equal to the salary at the lowest grade of employees of their cadre in the establishment. When the contractor fails to ensure his responsibility, the liability shifts to the Principal employer.
Employers have to exercise abundant caution while engaging trainees and take care that under the guise of training, such persons are not required to perform regularly like permanent employees and no training is imparted.
The move is set to ease this situation. But the execution or the enforcement of the provisions makes a great deal in realising this objective.
Compensatory off provision is available only for exempted workers considering the urgent and criticality of the activity and not for all cases in general as provided in respective state factories Rules. The amendments to section 65 will provide the limit of quarterly overtime hours to 144 hours instead of the current 75 hours and the condition of consent from workers for overtime work is specifically added.
