Apprentices Act would prevail over ID Act: Rajasthan High Court

Rajasthan High Court in Indian Oil Corporation Limited vs. Narendra Singh Shekhawat & Anr [S.B Civil Writ Petition No. 8182/2005] while resolving the conflict between the provisions of the Apprentices Act, 1961 (“Apprentices Act“) and the Industrial Disputes Act, 1947 (“ID Act“) reiterated the settled principle of law that disputes under the Apprentices Act cannot be treated as ‘industrial dispute’ under the ID Act because the Apprentices Act is a special statute for apprentices and thus would prevail over the general statue like the ID Act.
