Appeal in employee compensation matter can be considered on substantial point of law: SC

Supreme Court in Fulmati Dhramdev Yadav vs. New India Assurance Co. Ltd [Civil Appeal No. 4713 of 2023]on September 4, 2023, observed that in keeping with the principles of the legislation being intended for social welfare and protection of employees; the Commissioner being the last authority on facts; the scope of an appeal under the Employees’ Compensation Act, 1923 (“ECA“) being limited only to substantial questions of law and therefore, the court in First Appeal has transgressed the confines of Section 30 of the ECA.
