It is for Tribunal to adjudicate employment status : Calcutta HC

Calcutta High Court, in Indian Institute of Management Calcutta (IIMC) vs. Union of India & Ors. (WPA 28424 of 2024), recently the court observed that a mere denial by the employer is insufficient to negate the existence of an employer-employee relationship. Reaffirming that employment status is a mixed question of law and fact, the court directed that such matters must be adjudicated by specialized forums under the ID Act and concluded that the Industrial Tribunal is the appropriate forum for determining employment status in disputes.
