Disciplinary inquiry to be concluded within six months

Raj. HC in the case of  Sardar Mal Yadav vs. State Elementary Education and Ors. (S.B. Civil Writ Petition No. 807/2012), recently stressed the obligation of employers to complete departmental inquiries against employees within a reasonable timeframe. The court held that such inquiries should ideally be concluded within 6 months, with any extensions requiring reasonable justification based on the nature of the inquiry. Referring to Prem Nath Bali vs. Registrar, High Court of Delhi & Ors. (AIR 2016 SC 101), the court reiterated the Supreme Court’s directive for expeditious completion of inquiries, particularly when the employee is under suspension. Consequently, the Rajasthan High Court directed the state government to establish a mechanism to ensure that departmental inquiries are completed without undue delay.
