Gujarat High Court in the case of Kishan Arvindbhai Makhecha vs. Office of Chief Commissioner for Persons with Disabilities & Anr. (SCA No. 606/2025), has directed the Commissioner for Persons with Disabilities to adjudicate an employment discrimination case within six weeks. The petitioner, a disabled employee suffering from restricted mobility due to a congenital spinal cord dysfunction, alleged that he was denied a promotion solely on account of his disability. Despite his physical limitations, he was assigned a role that required door-to-door sales, making it challenging for him to discharge his duties effectively. Although the Disability Commissioner had previously ordered his reinstatement, the employer failed to restore him to his original post or assign him any meaningful work. Instead, he was transferred to a department where employees were required only to mark their presence without being given active duties. The High Court, recognizing the gravity of the allegations, emphasized the importance of expeditious adjudication in matters of disability rights and directed the Commissioner to resolve the dispute within the stipulated timeframe.
