Delhi High Court, in Prof. Sachidanand Sinha vs. Jawaharlal Nehru University [W.P.(C) 16488/2024] , held that the employer could not deny the employee’s leave encashment solely on the basis of a chargesheet filed against him. The court observed that the mere filing of a chargesheet, alleging the employee’s participation in a one-day strike, did not constitute valid grounds for withholding leave encashment.
