Vague Eligibility Criteria in Job Advertisements Should Benefit the Candidate, Not the Employer: Madhya Pradesh High Court

Recently, the Madhya Pradesh High Court in Birendra Singh Yadav vs. The State of Madhya Pradesh and Ors., W.P. No. 31629 of 2024, held that disqualifying a candidate for holding a higher position than the one advertised did not bar the candidate from applying for the advertised position, as the advertisement did not specify qualifications to the contrary. The court affirmed that when a job advertisement contains vague eligibility criteria, the benefit of the doubt should be given to the candidate, not the employer.
