Dismissal for absence due to personal hardship would be illegal : Chhattisgarh High Court

Chhattisgarh High Court in Kudiam Bhima vs. State of Chhattisgarh, WPS No. 227 of 2020,on October 14, 2024,  reinstated an employee who had been dismissed for unauthorized absence due to personal hardship. The Court held that dismissal may be considered excessive when the employee has a long record of service, and the absence is due to compelling personal reasons, such as illness or family emergencies, which cannot be deemed deliberate unless there is clear evidence to support such a conclusion.
