Maternity benefits cannot be denied on technicalities: Madras HC

Madras High Court in Tamil Nadu State Transport Corporation (Coimbatore) Ltd and another vs. B Rajeswari W.P No. 1692/2022, On January 12, 2023,  allowed the maternity benefit to the female employee who was employed on temporary basis while referring to the judgment of Supreme Court Municipal Corporation of Delhi vs. Female Workers (Muster-roll) and another (supra) wherein it was held that female workers even working on casual basis or on muster roll on daily-wage basis should be given maternity benefit and a woman employee cannot be compelled to undertake hard labour at the time of advanced pregnancy.
